The officers of Anti-Corruption agency under the State Security Service of Georgia, as a result of operative-searching and investigation activities, brought to Criminal Justice Iza Z., the acting representative of head of Martvili Municipality in village Gachedili on the fact of official duty negligence and Kakha B., a resident of village Gachedili, Martvili Municipality on the fact of swindling in large quantities and Issuing and using of forged documents.

Investigation established that Kakha B., whose family, according to the Zugdidi Local Archive records owns 7700 square meters of yard, decided to register the 6001 square meters state-owned agricultural land plot located close to his yard in village Gachedili, Martvili region through swindling and on the basis of the mentioned archive  records and for this purpose prepared cadastral survey plan. 

Iza Z., the acting representative of the head of Martvili Municipality in village Gachedili fulfilled her duties unduly, didn’t examine the  attached documents thoroughly, and issued the orders indicating that the land plot showed in the property rights documents presented by Kakha B. is identical to the land plot which is indicated on the cadastral survey plan, which doesn’t correspond to reality.

Using of this document, Kakha B. illegaly registered  30 005 GEL worth, 6001 square meters of state owned land.

Investigation is in progress on the fact of official duty negligence (Article 342, of the Criminal Code of Georgia, which envisages a fine or up to 3 years of imprisonment.), on the fact of swindling in large quantities and issuing-using of the forged documents (Article 180, Part III, sub-paragraph “B” da Article 362, Part I, of the Criminal Code of Georgia), which envisages from 6 to 9 years of imprisonment.

Investigation is carried out by the Anti-corruption Agency under the State Security Service of Georgia.

The mentioned land plot is sequestered by the investigation and the procedures  have started to return land plot to the state.
